Problems with the Constitution...

Recommended Posts

I have some problems with the constitution and I think it would serve better if I listed them out

3.7 - I believe all nations have the right to vote on who represents them. The problem lies in nations making multiple accounts to sway elections. This can be solved by determining if multiple IP addresses are voting. Maybe a nation will have to be in the realm for a certain amount of time before even voting. I feel there is definitely a way for ALL nations to vote without corruption occurring. Potentially Hide Results and have the nation say they voted. (This could be a job of the Interior Ministers potentially, his job says to prevent Espionage...)

4.2.4 - Senators should either not be WA members or have a WA nation and a non-WA nation. I feel like Yggardsil is a lot like Rome when the Patricians had complete control. Give power to the Plebeians (Non-WA Nations)!

5.1.1, 5.3., 8.1 all make references to WA members. I think all nations should be allowed to participate. Even though the UN exist, many of its problems involve non-UN nations. Maybe Ygg's change in mentality could trigger a whole change of thought for Nationstates. That is my dream.

Article V. Elections

5.1. General Procedures

5.1.1. Only Yggdrasil WA members are eligible to stand for election. Members interested in running for the Senate or the Chancellor's (Delegate position) must notify the whole region through the forum during election season. Nations may only run for and hold one position at a time.

5.1.2. Elections shall follow a course of seven days for nomination and campaigning, followed by a period of seven days for voting.

5.1.3. All Senators shall have a term of
four months
starting from the conclusion of elections. Existing Senators may seek re-election but no nation shall serve more than
three consecutive terms
unless decided otherwise by a vote of the Council.

5.1.4. The Regional Development Minister shall have a term of
four months
starting from the conclusion of elections. The incumbent Minister may seek re-election but no nation shall serve more than
two consecutive terms
unless decided otherwise by a vote of the Council.

5.1.5. The Lord Chancellor (Delegate) shall have a term of
six months
. The Chancellor may seek re-election at the end of his term but shall not serve more than
three consecutive terms
.

5.1.6. If a Senator or Minister vacates his seat before his term, the Council will deliberate whether or not to hold a replacement election immediately or wait until the next scheduled round of elections. If a Chancellor vacates his seat before his term, a replacement election will be held as soon as possible.

5.2. Voting

The binding principle behind the actions of Yggdrasil is the fair and democratic representation of the region. Whenever possible, votes with the largest possible groups of electors will be held.

5.2.1. In the event of a tie, voting will be extended by seven days to allow more members to vote. The candidate with the most votes at the end of two weeks of continuous voting (or three weeks including the first week of nomination) will be declared the winner. If at the end of two weeks, the votes are still tied. The contested position will be decided by a vote of the remaining Council members.

5.2.2. If an election position is contested by only one nation, the voting will proceed with "I refuse to vote for candidate name" as an alternative choice. If in the unfortunate scenario the sole candidate accumulates a lower vote count than "I refuse to vote for candidate name", the election will be declared a mis-vote. In such a case, the Chief Executive may either call for a new round of elections, or appoint a suitable candidate to fill the position.

5.3. Eligibility

All WA members registered on the forum are eligible to vote in elections as well as any regional issues on ballot. To ensure equal suffrage in regional affairs, each WA member shall have one vote. If a player is in control of multiple nations, it is illegal for him to cast multiple votes.

Article VI. Conditions for Ejection

Whereas Yggdrasil is a free region with open borders, conduct that will lead to a nation's ejection from the region should be clearly defined.

6.1. Posting of any content considering spamming. Spamming is defined as any activity that is considered obscene, illegal, threatening, malicious or defamatory, or advertising of regions, forums, websites, and other causes not related to Yggdrasil.

6.2. Griefing another member in Yggdrasil. Griefing is defined as acting with ill-intent to annoy or upset other people.

6.3. Attempting to steal another nation's identity or impersonate another player, including attempting to hack nation or region passwords. Any such activity will be reported to NS moderators.

6.4. Invading other regions or war-mongering. Yggdrasil is a peaceful region and will not harbor invaders or condone such activity. Known nations of invader groups may be ejected at the discretion of the Chief Executive or Chancellor.

6.5. Gross misconduct. Members are expected to behave with high honesty. Dishonest behavior, including election fraud, or any other attempts to deceive or mislead the region will not be tolerated.

6.6. Plotting against the region. Any member found to engage in subterfuge, espionage, sabotage, usurpation of power, intimidation of member nations, and other such plots with the primary aim of destablizing Yggdrasil and her government, will be immediately banjected.

Article VII. Miscellany

7.1. Emergency Powers

A state of emergency may be declared in the region in two instances. Both of which will render all other parts the Constitution void with the exception of this section. A state of emergency may be declared upon:

7.1.1. Founder Expiry/Deletion

The Council shall have emergency powers over the region, exercised through the Chancellor/Delegate, immediately after the expiry or deletion of the Chief Executive (for any reason). Council members, led by the Chancellor, are to follow procedures outlined in 'Founder Expiry Emergency Act' for the appropriate scenario. Any action taken without the backing of the Council is deemed illegal and may be subject to ejection or ban by the Chancellor/Delegate.

7.1.2. Imminent Danger to Yggdrasil

The Chief Executive may also declare a state of emergency if he detects an imminent threat to Yggdrasil's survival. The key word being
survival
. Potential scenarios may include, but are not limited to: An invasion by an aggressor region or regions, NS-moderator actions that threaten Yggdrasil and her members, and a severe lull in activity in the region and Council of Elders.

7.2. Motion of No Confidence

Every official, with the exception of the Chief Executive, may be made subject to a motion of no confidence. WA members not within the Council of Elders may privately contact the Chief Executive to start a motion of no confidence, provided the requisition is accompanied by the written endorsement of three WA members. The Chief Executive will then proceed to introduce a motion of no confidence. The motion will be subject to a general vote of WA members lasting for seven days. A two-thirds vote margin is required for passage (the accused member shall not vote). When such motion passes, the official will be removed from office.

7.3. Impeachment/Chastisement of the Chief Executive

The Chief Executive may be subjected to impeachment. An impeachment vote is akin to a chastisement of the Chief Executive for the Chief Executive's handling of the region and does not amount to forced removal from office. WA members not within the Council of Elders may privately contact their elected representatives (Senators or the Lord Chancellor) to force a vote of impeachment, provided the requisition is accompanied by the written endorsement of ten WA nations. The Council, absent the Chief Executive, will then proceed to introduce a motion to impeach the Chief Executive. The motion will be subject to a general vote of WA members lasting for seven days. A two-thirds vote margin is required for passage (the accused member shall not vote). When such motion passes, the Chief Executive will be impeached.

7.4. WA Endorsement Rule

With the exception of the WA Delegate (Chancellor), the practice of endorsement swapping is strongly discouraged. WA member nations are free to endorse whoever they please, so long as it is done out of free will and no written request was carried out.

Any nation which at anytime receives more than three-quarters of the current endorsements of the serving WA Delegate shall be given 24 hours to reduce the number of endorsements. Failing that, he will be subject to ejection from Yggdrasil for a period of 24 hours to clear out his endorsements.

Article VIII. Ratification and Amendment

The Ratification of this Constitution shall take place two full weeks following discussion by founding members, after which members not willing to observe its provisions may take liberty to seek other regions.

8.1. Proposal and Enactment of Amendments

An amendment to this Constitution may be carried out in the following two ways:

8.1.1. Via the Council of Elders

The Council may propose and vote to enact an amendment so long as the changes are minor and technical in nature and no amendments have been carried out in the past 6 months. To pass an amendment, the Council poll must achieve a majority of 70 percent in favor.

8.1.2. Via a Regional Poll

Any WA member may propose an amendment, so long as he receives the written support of ten WA members. The Council shall then poll all citizen nations on the proposed amendment in the forum for one full week. In order to pass, the regional poll must achieve a majority of 70 percent in favor.

Originally ratified by all founding members on 16 August 2008. Amendment ratified by regional vote on 30 April 2010.

And now a few other Quotes

Announcement of Change in the Forum

Currently in the forum, there are two basic masks, WA members and Non-WA members.

  1. When you first register, you are a newbie and has a New Member.
  2. Afterwards, people get either the WA member mask, or Non-WA member mask.

The benefit of the above system is that I can allow only WA members to vote in the elections, polls, etc. This way, we increase our security because people cannot make two or three non-WA nations and swamp the vote.

The negative of this is that it is complicated, and hard to keep track of people with shifting WA membership. Some folks resign from WA, or cease to exist , and then when they return become non-WA... I had Trav-Coch keep track of them for me in the past. Kudos to him its a ton of work... :salute: Now that he is gone :rip:, I don't really have the energy to constantly update the masks every election. :coffee_n_pc:

So I'm going to do away with this complicatedness, and simplify stuff. When people register next time, they will immediately be placed on the Members mask, which enjoys all the privileges as WA members. If you CTE, you mask remains the same. When you get back, it's still the same.

All other masks remain, including Chancellor, Senator, Minister, and hidden YDS masks.

Changes will happen 4 days from this message.

Oh, and also, with effect immediately, I have shut down the Valhalla part of the forum. There is really no point when Val's population has dropped so low.

:valsmiley:

As far as the Forums Masks are concerned, there is no difference whether you are WA or not. If it is to be decided to rectify the Constitution, We would need to design where to change it here and then put it to a vote- But first notify GRO of the desired changes, as it is ultimately her call as the founder.

The forum has a IP checking script. Accts with the same IPs can be easily found out. However, there's still no stopping people using proxies to hide their IPs--- which is the same case before the change or after the change.

(In other words, if people really want to cheat, there's really no stopping them... =p

The new way as of May 9th is an IP checker, so that you can "easily" find out if two nations vote in the election, so it really all comes to to this: Where do we change it? Does everyone agree? And finally, Whats GRO's opinion on the matter?

The WA being necessary seems to me to be a little... outdated. If we have the IP checker and WA was only implemented to catch cheaters, In which case the mask has already been removed, then we should remove the middle man to further improve the equality and activity of the region via the constitution.

I propose this:

3.7. Right to Vote

All WA members registered on the forum will have the right to participate and vote in elections in accordance to the region's Constitution and laws.

be changed to:

3.7. Right to Vote

All Yggdrasil citizens registered on the forum will have the right to participate and vote in elections in accordance to the region's Constitution and laws.

Furthermore:

5.1.1. Only Yggdrasil WA members are eligible to stand for election. Members interested in running for the Senate or the Chancellor's (Delegate position) must notify the whole region through the forum during election season. Nations may only run for and hold one position at a time.

5.1.1. All Yggdrasil citizens are eligible to stand for election. Members interested in running for the Senate or the Chancellor's (Delegate position) must notify the whole region through the forum during election season. Nations may only run for and hold one position at a time.

And finally:

5.3. Eligibility

All WA members registered on the forum are eligible to vote in elections as well as any regional issues on ballot. To ensure equal suffrage in regional affairs, each WA member shall have one vote. If a player is in control of multiple nations, it is illegal for him to cast multiple votes.

8.1.2, however...

8.1.2. Via a Regional Poll

Any WA member may propose an amendment, so long as he receives the written support of ten WA members. The Council shall then poll all citizen nations on the proposed amendment in the forum for one full week. In order to pass, the regional poll must achieve a majority of 70 percent in favor.

The IP checking we can watch for double voters from the forum, however this goes past the forum and into NSG itself.

Is it WA nations in Yggdrasil, one of the 230 some odd? or does it apply specifically to the forums?

This needs to be more specific, if I had written support from 10 other nations not in the WA, then it could all be the same person.

And with the changes above, anybody, with a little intelligence, can modify this charter to their liking.

There for, I propose to keep 8.1.2 the same, so as to keep our region safe from the very things we are modifying to protect ourself from.

With these changes, I also Imply to add a new legislator:

5.4. Consequences

Should a nation be accused of illegal voting, via casting multiple votes as per multiple nations, bribery, or blackmail with the intent to sway the vote in their favor, they shall be made to stand trial to a jury appointed by the current senator as of section 4.2.4

Furthermore; the vote shall be classified as a miss-trial, and a new vote will be caste.

Should a nation who is running for office be accused of illegal voting, the same shall apply, but with the exception of the votes to be suspended until a conclusion is reached.

Should there be no current senators in office, the jury is to be appointed by the current Delegate, and/or made up of the current council.

As such, the new constitution should read as:

The Constitution of The Realm of Yggdrasil

5.3. Eligibility

All Yggdrasil citizens registered on the forum are eligible to vote in elections as well as any regional issues on ballot. To ensure equal suffrage in regional affairs, each citizen shall have one vote. If a player is in control of multiple nations, it is illegal for him to cast multiple votes.

Should a nation who is running for office be accused of illegal voting, the same shall apply, but with the except of the votes to be suspended until a conclusion is reached.

Should there be no current senators in office, the jury is to be appointed by the current Delegate, and/or made up of the current council.

Allowing only WA nations to vote and participate in elections is pretty much the norm in most larger regions, why should we be different? I think there are good grounds for the present system to stay.

The IP checker is not foolproof, if somebody is determined, he/she can easily bypass that with proxy servers. I had been in the defending game for many years, and have seen first hand how determined invaders could infiltrate regions, takeover, and destroy them. Since our region's direction, including our Constitution, is set by the Council of Elders, allowing non-WA nations to easily enter that Council opens up our region to risks. To put it simply, how do I know non-WA nations are really loyal to Yggdrasil? For all I know, their WAs might be in an invader or imperialist region seeking to destroy us from the inside.

Having our present requirement of WA nations to vote and contest in elections add another layer of security because NS Admins said they use 4 different ways to detect multis.

Lastly, a change of the Constitution can only be carried out through actions stated in clauses 8.1.1 and 8.1.2, which means either you have to be in the Council already, or you must be a WA nation yourself and convince 10 other WA members to accept the proposition that Non-WAs can vote and stand in future elections.

Non-WA nations are already functionally allowed to vote. I am assuming you could see the voting area during the last election?

Vrolondia, thank you for being so hopeful bro!

GRO, I mentioned how nations should become naturalized by staying here for a certain amount of time. Think about it. Also, the fact that I am not even allowed to suggest amendments or anything in general as a non-WA nation is ridiculous. Look at the American system, a court case can be appealed and eventually travel to the Supreme Court. I feel like if Yggardsil had a court system, only WA nations could appeal. GRO, you have a majority Plebeian class and a minority Patrician. I hope you understand that reference.

Zybodia, non-WA nations can vote but the constitution makes it sound like these votes are void and don't count. Am I suppose to magically just assume something different? Your constant instigation with me will lead to the enslavement of your people and the eventual decoration of my city with the broken gods of your civilization.

All I'm saying is that if nonWA nations are able to vote either way, might as well take it out of the constitution since it doesn't really matter.

I see what GRO's saying about security, but we can use Alyekra as a precedent in this situation, and have it so that if you actually want to run you need at least one nation in the WA.

Besides, it really comes down to the people on the forum that are running. The average non-forum nation wouldn't be able to run regardless.

It would be naive to suggest everyone has good intentions, but I really want to believe so.

Well, so the masking change I brought up only happened 2 months ago. Currently non-WAs are not allowed to vote, but there is no way to ensure this is the case. If you are so opposed to receiving information about the situation, I don't have to give it to you, but it will make any change you are trying to make that much harder if you are uninformed.

Then why are you flooding this thread with essentially disinformation? That is honestly how I see it. We could easily make a section of the forum for countries that have earned their Yggardsil citizenship. That way, the whole functionality problem is an issue of the past.

The goal of the forum-mask reform which we did 2 months ago was to reduce the amount of work an Admin had to perform checking each citizen. If we are to assess nations on whether they 'earn' their citizenship, it would essentially undo that reform in terms of the amount of work and separating nations into two groups.

@Vrolondia:

I think the topic of updating the Constitution can be debated in Council chambers, if one of the govt members want to bring it up. I am prepared to accept allowing non-WAs to vote but not for them to stand in elections.

It is not fair that GRO (A non-WA nation) gets to be treated like a WA nation. All I was asking that non-WA nations get naturalized in Yggardsil after a few months of staying in here. There could be a thread to show you have been a member since. I bet there is a way to set it up to do it for you.

Not really; how hard is it to have your WA nation here if you consider this your home region?

Here's my proposal:

7.5: The Plebeian Act

7.5.1 The Chief Executive or the Council, by a majority vote, or the may grant a non-World Assembly nation the title of "Honorary WA-Member" and the following rights:

7.5.1.1 The right to vote in any election.

7.5.1.2 The right to stand for any election except for the elections for Chancellor.

7.5.1.3 The right to propose amendments to the constitution.

7.5.1.4 The right to vote on amendments to the constitution.

7.5.2 The following rights may not be granted to a non-World Assembly nation

7.5.2.1 The right to stand for an election for Chancellor

7.5.2.2 The right to vote on Yggdrasil's stance on World Assembly proposals.

7.5.2.3 The right to vote on Yggdrasil's stance on Security Council proposals.

7.5.3 Any nation applying for Honorary WA-Membership may be required to give a justification for his non-membership.

7.5.4 The Council has the right to require that nations applying for Honorary WA-Membership prove that their "Real" World Assembly membership is not being used for raiding or other forms of foul play.

7.5.4 The rights of any Honorary WA-Member can be repealed by the Chief Executive or by the council with majority vote.

7.5.5 The title of Honorary WA-Member shall not be bestowed upon nations using their World-Assembly membership for raiding, invading etc.

How's that?

The WA restriction in this case has nothing to do with roleplay. There are issues of regional security which trump roleplay. Your two nations don't have to do anything with each other. The fact that you, as a player, control a Yggdrasil WA nation is sufficient. (Especially given that you are only allowed one account on the forum.)

Okay and that is fine. However, what about non-WA nations. There are too many restrictions on them. The fact that I can't even suggest laws or amendments is ridiculous. There is a better way to do things and the reason this isn't happening is because yall implemented a faulty one two months ago and don't want to work again.

The Constitution was last amended two years ago.

You know what, you can't technically suggest amendments, but pretty much everybody else who's posted here is on the council. If you come up with something reasonable, I'm sure you could get somebody to bring it to our attention. (I mean, we could talk about it now, but that would take your voice out of the conversation.)

Zybodia's right , you should work with Aleyktra on this. As a Senator , he can propose new statutes to improve the region. It's part of his job after all.

Sounds good to me, My only problem with it is you don't address the mask in this post. If Non-WA's can vote either way why penalize them for it?

I can understand not letting Non-WA's run for election, and you address it quite nicely as to how they would be able to do so however.

I assumed they would get a separate mask.

Nope, that's why I'm trying to amend it. They had their own mask, but it got removed about 2 months ago, so it seems pointless to have it in the constitution that they can't vote, but then not have anything to actually keep them from voting. Just seems to me that if they can vote we will get some more activity in the Forums.

But yeah, as for running I think that WA only should be able to do that unless they have another WA nation in the region
